End User License Agreement

GameNest is free and open-source software. This document explains the terms that apply when you install or use the GameNest desktop application ("Software"), provided by [OPERATOR LEGAL NAME] ("we", "us"). By installing or using the Software, you agree to these terms. If you do not agree, do not install or use the Software.
1. Your licence
The Software is licensed to everyone, free of charge, under the GNU Affero General Public License v3.0 (AGPL-3.0). The full licence text ships with the Software and is available in the source repository. You may use, study, modify, and share it under those terms. There is no paid edition — every feature is included for free.
A small ee/ portion of the source is reserved for future commercial features under a separate licence; it is empty today and is not part of the desktop application.
2. Acceptable use
The AGPL grants broad rights to use and modify the Software. In addition, you agree not to use the Software to break the law or to infringe others' rights, and to keep intact the licence and copyright notices that come with it.
3. Game servers and third-party software
GameNest orchestrates third-party game-server software inside containers. You are responsible for complying with the licences, terms, and EULAs of any game, server software, mod, or container image you run. We grant you no rights to third-party games or content, and we are not affiliated with their publishers.
4. Updates
The Software may download and install updates automatically to stay secure and working. You can check for updates from Settings.
5. Disclaimer of warranty
The Software is provided "as is", without warranty of any kind, to the maximum extent permitted by law (see also the warranty disclaimer in the AGPL). We do not warrant that it will be uninterrupted or error-free, or that it will prevent data loss. Keep your own backups.
6. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost data, profits, or game progress. Nothing in this Agreement limits liability that cannot be limited by law (including liability for intent or gross negligence, or under mandatory consumer-protection law).
7. Governing law
This Agreement is governed by the laws of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections of your country of residence still apply.
